What is the name of your state? TX
Ok, I'll try this again. I posted a few questions ths weekend and due to being arrested for false allegations, became very paraniod and deleted them.

Me not withstanding, two charges against me 1. Interfere w/911 call 2. assault.

I was arrested, charged, and arraigned for the interfere with call, and the judge issued a emergency protective order on that alone, not the assault citation.

My attorney had a hearing today where she motioned to vacate based on her interpretation of Interfere w/call not being within the provisions of family violence. I know one of you gracious respondants here stated that, in fact, it does fall under those provisions, down here in TX.

The motion was denied by magistrate, but my frisky little attorney is not only willing, but is wanting to appeal that decision. I told her to go for it, but what do I know.

I use "frisky" with all due respect. She is a young 29 or so with maybe 3 years since she started practicing.

Two questions;
1. As dumbed down as it can be explained (I've even read the statutes as well as the house bill that speaks to this subject 'till my eyes bleed and cannot clearly differinciate) are we-is she wasting time with an appeal and if so, (make this part dumb) why?

2. Everything I read about any allegations, false or otherwise, insist the accuses should shop arround with regards to a lawyer and make sure they are experienced. I like new blood that has energy and that's not so connected they loose sight of their clients. But I also realize I myself may be guided by my burning desire to "tell my story". Should I worry about experience?

Thanks!
