interference with visitation

I spoke w/ my lawyer today. He spoke w/her lawyer she is using the fact that yes I made the mistake of putting my 7yr old in the front seat. But it was once, now that I know I will put her in a booster in the back. This is what she told her lawyer and won't let me have her. Her lawyer advised her to just follow the court order, but I guess she just kept carrying on about stuff so he told her to do what she wants and if she doesn't like his advice she can find a new lawyer. He told this to my lawyer today, and he thinks she is crazy and is fet up w/her. Finally her true colors are shining through to him. I am still waiting for my court order w/ the judges signature, my lawyer said I should have it by today. My next visit is Tuesday. She doesn't know I know all this. So as someone said no her lawyer is not issueing any emergency order I think he is just going to let her hang her self.

So I will continue w/my order, because I should have the original in hand by the next visit.

Question though, If my ex is not present when I pick up my daughter and say her boyfriend has her at home and I go there and he refuses, I then call the cops, If he still refuses can he get arrested?

The other thing is if she is not at daycare or at home, I know she hides her at her boyfriends parents house, can I go there, and again demand to take my daughter, if they refuse call the cops, and again if they still refuse can they be arrested?

No one will be arrested- Yet. You need to show up per the court order. If the child is not there, you file a police report for denial of visitation. You do that EVERY SINGLE time you are denied visitation. Then you take it to court and file contempt charges against the Mother. Initially she'll probably get a warning- but it will start a trail of evidence and when it continues to happen the Mother will risk fines, jail time and even eventual loss of custody.

So- Show Up. Bring your court order with you. Call the police and file a report if you are denied visitation. Document everything. Eventually this Mother will hang herself.

I have a question on this one

Court order is in X County.

Ex lives in Y city.

Would he go to Y City to file the Interference with Visitation charges?

Am asking because when I go to Y city to request a report, I am told that ti is a civil matter and they do not get involved in those issues. (Same for when I try the Sheriff's office - it's within the city limits of Y, they don't get involved; it's a civil matter, they don't get inovlved.) Now if the child was being abused - different story, but not for denied visits.

It falls into the proverbial loop --- file in court. When you file in court, where is your proof - police reports, etc? Can't get the reports.

That it was just my little corner of the world, but apparently its global. Nice to know that our city / county isn't the only one passing the buck.
