My husband was recently hurt and he had taken a letter from the doctor to Child support Enforcement from the doctor himself saying that he was not able to work from date to date. And Child support Enforcement said that the child upport would be put on hold until further notice......My husbands brother had recently got a letter saying---------------------------------------------------------------------------------------------------------------------------------------------------->>>>I need you to do me a favor.....Please get a hold of your brother and tell him to get me some MONEY ASAP**************. The State of FL is going after him and there will be a warrant for his arrest within the next week or so **************. I had to sign the Interstae Papers..... Tom has really put me in a bind..... He is currently $9,800.00 in arrears. The least he can do is send me $1,000 of that money immeadiatly. That is not much to ask for.... I need some help supporting Kristy.... She has currently made the Cheerleading Team and the fee's that come with it are tremendous...This is not fair....I will not do anything unless he makes an effort.....I have hired and attorney for a contempt.... This will most likely end up with him in Jail and a purdge amout of half of what he owes me... When the judge finds out that Kristy needs braces Medicaly he is not going to be very happy.... THIS IS GOING TO BE THE UGLIEST BATTLE YET!!!! But I dont know what else to do!!!!!!

So has he FORMALLY filed for a modification?

First, is the order in Florida? If it's in another state he'll also need to provide proof of disability to the state that the order is in.
He needs to file for a modification ASAP. As long as he can prove his disability, prove that he gave the medical documents to the CSE's in both states, and file for a modification, no he cannot be found in contempt and jailed.

The letter that your husband's brother recieved- was it from the CSE ? Why was the letter sent to his brother rather than him, is his ex and CSE aware of your home address?

The Florida CSE is real good about accepting Dr.'s statements so something is not right about all of this, but just in case, he needs to do something ASAP.

;) Thank you for that genrous letter, I really have alot of respect for people that dont even know me and my husband and are doing what they can to help (GOD BLESS YOU) Well come to find out that everything that has came out of his Ex-Wife was nothing but lies,upon lies------>Me and my husband spoke to CSI in FL anmd they said to contact G.A, so which of course we did and we talked to them and CSI in GA has not even recieved any paper work on this case what so ever, But they did say that we need to either send CSI in GA all the paper work that the state of FL has and get it to them ASAP and just keep them informed about every process that is/going to be taken..... I am so thankful for the tecnoligy that we have now ahhhh days-----> And thank you again for replying to my message, We dont this kind of stuff going on in our lifes right now,no one needs this kinda of stress but i guess that just comes along with life, At which I am thankful for..... Even when going gets rough we have to keep our heads up and keep on going.....

But be aware that an abatement of the support does NOT mean it stops adding up - and even possibly accruing interest.

Actually in Florida an abatement will stop everything from accruing. Although the prior arrears won't change, the interest on them will stop accruing and when there's a medical reason for the abatement it CAN (it's in each Judge's descrection) stop on-going support from accruing.

OP: I'm still not clear on if the order is in Florida or Georgia. This post applies to Florida only, I don't know if Georgia allows the same thing or not.

G.A is trying

I had called G.A Child Support Enforcement and they had said that they are trying to open one...... But my husband and his ex-wife got a divorce in Naples FL and when they did that the Set Child support amount of $85.00 a week, so I really dont understand the fact How does G.A have anything to do with it except the fact that his ex-wife lived in G.A for a little while but she is now back with her ex-husband in Lakeland FL...... I dont understand the fact on how G.A has anything to do with it? Once my husband get disability we will be able to pay it again but for now we just cant stand the treats!!! I know that he will still have to pay the arrears and as long as he dont pay it just keeps on adding up, but if he gets on permanent disability CSE of FL told us that the payment will stop all together and all he will have to pay is the arrears....

GA CSE people are complete idiots (especially if they are in the Douglasville office). My husband had very similar problems with them so your husband may have to do the same thing my husband had to do.

Your husband needs to get a copy of the CS order, go to www.flsenate.gov/STATUTES/ and print out statutes 88.2051 and 88.2071. He should send those to the GA CSE with a lettter FIRMLY stating that the order originated in Florida, and that Florida has jurisdiction. He should also state that ex now lives in Fl. (adding ex's address). He should then state that according to the laws thier CS agency CANNOT do ANYTHING with this case and that he insists that if they have any further requests they should be directed to the Fl. DOR CSE and that he WILL NOT SUBMIT TO THIER JURISDICTION.

It took 4 letters and dozens of phone calls from my husband to get them to understand that thier office has no legal authority, so your husband needs to keep copies of all letters he sends them. They are very stubborn, but eventually they do give up and let Fl DOR do thier job.
