I'm an independent consultant being paid on a 1099. The company I've been working for is having cash flow problems & has not paid employees or suppliers for 6 weeks before suspending operations. As a supplier, I must get a judgment against them to have any hope of collecting any percentage of what's owed if they are to go bankrupt. My question is, if I can get them to give me a Promissory note for what's owed, does that give me legal rights to their assets if bankruptcy happens?
