Is a homestudy required for any adoption?

What is the name of your state (only U.S. law)? AL

We are looking into a local adoption of a baby that a grandmother has custody of. We have not been in contact with her yet, so I am not going to contact a lawyer until I know for absolutely sure that she still wants to give the baby away. The man who knows about her situation and how to contact her will be back from vacation as of tomorrow, so we will hear more then. The mother contacted the man who is a church van driver, for him to help her and her mother (the grandmother) find a good church family for the baby. We are trying to asses a general cost of this private adoption. My question is, Are homestudies required for all adoptions, even one like this situation where it is a private adoption between the grandmother and my husband and myself. We have no problem with a HS but I was just under the impression that it would not be required if it were this type of situation. I keep getting conflicting answers. I will contact a lawyer as soon as I know that this is a tangible possible adoption.

Were both parents' rights actually terminated by the court?

You forgot one person in your equation...the father.
You WILL need an attorney to look at your specific situation.

Yes, the father beat up the baby and it was placed in the hospital which it has since been released. THe mother did not stop it and as a result both parent's rights were terminated.

That was fast, court-wise.

So the Court placed the baby in the custody of Grandma? And she has all the legal rights to determine placement?

Yes, the grandmother has all rights. The grandmother has permanent custody. And I don't know how "fast" it was, from what I know this has been going on for months. The baby was placed in the hospital months ago and since then DHR has been investigating and the parent's rights were terminated. Could someone please just answer the actual question?

Exactly, because it seems that the court would still have jurisdiction over the "baby." How old is this baby anyway?

All i know so far is that the baby is under a year. As I said I won't know more until tomorrow

How 'bout you just go HIRE an attorney, and speak to him/her in any fashion you wish?
