What is the name of your state (only U.S. law)? Alabama

I am being sued by Capital One for $18K. I have been working with a settlement company. Should I continue trying to settle or just go ahead and file bankrupt?

If I do file bankruptcy which should I file 11 or 13? I want to keep my house.
