My daughter filed for CS after her bf and her broke up..last May 2004 I believe. The child was just over 1 years old and parents were never married. Father signed Affidavit of Paternity and had DNA tested per court order.(case involving protective order, not custody etc)
I filed for Legal Guardianship of my granddaughter shortly after, and was appointed Guardian in June, 2004.
Child support filed for a court hearing against bio-father for CS in January, 2005. I contacted CS, and after filing Power of attorney papers to speak about the case AND filing new papers to change custody of child legally with CS, the case has been updated to my name.
At the January hearing, bio-father was assigned $163.00 per month CS with arrears at just over $3,000. At that time, they had an old address for him (the one the two parents shared) and I am to assume that this is where his court hearing papers went. I do not know if he ever filled out a forwarding address to his present address (his mothers house). I informed the CS office in January of his current address.(he has been with mom since the move and dissolution of relationship in March, 2004)
He is currently in arrears $4,600. A new court hearing has been filed, but no date set for the hearing. OK CS is trying to determine if they have him in CONTEMPT or not.
They do not know if he has ever received the Hearing papers from January. I do not know if he has either. He has not paid 1 cent toward the child since she was born...she is over 2 years old.
Is he LEGALLY in contempt? I have been reading OK statutes on this, but do not find exactly what I am looking for.
Any ideas? The case has been going for a year, with no resolution. IF it IS possible he is in comtempt then I will keep looking until I find the wording I am looking for in statutes and case law..if he is NOT, then I face another long wait until he is brought to court for his 'original' hearing.
