Is the LL allowed to touch/move my property?

I lease a commercial building for hobby use. As such I have a commercial lease, but I do not do any business there. There has been a big crime problem in the neighborhood lately, the business to my south just got robbed for the second time this year.

There is a small path behind my building that would make a great place for criminals to hide. (and it goes right between my door and the place that keeps getting robbed) I pay for this property, about 4' wide and 40' long, and, I'm allowed to use it for whatever I want as long as it falls within the industrial zoning limits. I normally use it for storage, but, because of the crime I have moved anything worth more than $5 inside, and, to act as a temporary fence at the end of this path, I piled up some old peices of wood and some steel barrels. I intend to build a proper fence very soon...

Anyway, apparently my landlord didn't like that and now my things are in a different location than I left them. They no longer serve as a fence. Some of the stuff is missing. It may have been "garbage", but it was still my garbage, and I'm allowed to store it there if I want to. The stuff that is missing may not be worth more than $10, but, again, I'm not in the business of giving my things away. Also nobody could have even seen this stuff unless they went snooping where they don't belong, because it's entirely behind my building. I even have before and after photographs.

I'm not worried about the value of the stuff, it's the principle that bothers me. Nobody should be touching my things. I might add there are four "NO TRESPASSING" signs easily visible in this area. The landlord never asked me to clean it up, nor did she ask permission to clean it up, or even notify me that she was going to clean it up.

My lease says the landlord is allowed to enter the premises at any reasonable time for the purpose of "examining into the condition thereof, or for any other lawful purpose". It says nothing about touching my property. Is she allowed to do this? I know she can ASK ME to move something she doesn't like...but does that mean she can just go up and move it whenever/where ever she feels like without notice?

This is hard because you don't know FOR SURE it was her, theres no evidence and no video tape.

Sure you can post "no trespassing" but the criminals and LL are going to ignore it.

Get some cameras that are hidden, it will help the crime issue, and you can prove the LL touches your stuff. (not that even if you could, theres a whole lot you can do about it though)

The problem with slum tenants is that their garbage grows and grows and grows. If you really have no right to that area, then then the landlord can trash any garbage you or anyone puts there. How is the LL suppose to know it was your misc crap that was stored there? Then there is the possibility that the city or county may have ordered the LL to clean out that area.

You're entirely wrong, as usual. Did you even read my post? You haven't got a clue what a "slum tenant" is. :rolleyes: As I clearly explained above I PAY FOR THIS PROPERTY, therefore I have EVERY RIGHT to that area, and NOBODY ELSE does! The landlord CANNOT trash ANYTHING I put there. The landlord would know it was my stuff there because it is on MY PROPERTY. And NO, the city had nothing to do with it. As I explained I am allowed to do whatever I want on this property as per my lease as long as it falls within the industrial zoning limits. If I wanted to I could literally open up a garbage dump there. This is NOT a residence and it is NOT in a residential area.

Even if the landlord DID have a reason to clean it up, which she didn't, would she not have to give me notice first? I don't want her dirty hands on my stuff, even if it is garbage.

And now I'm just going to bring in heavier garbage...like engines and concrete chunks. ;)

I still plan on letting her know how pissed off I am, and telling her never to attempt such a thing again.

I would just like to know if it is truely illegal for the landlord to touch/move my belonings or not? (and I'm not asking atomizer) Whether she wants to admit it is a different story...

I guess I'll just make it obvious to her next time anything moves I'll just call the cops and report a burglary. She can get arressted the same as anyone else. Theft is theft, even if it's only $10.

She blames the neighbors. :rolleyes: That is, the empty, overgrown lot next door. Yeah, I'm sure they came over just to sort my garbage, and spread some of it on their own property. *sigh* I would say she's as dumb as a box of rocks, but, that's insulting to rocks. It's kind of like when a 5 year old tries to lie to you, except she's about 25.

She's very clear now though, this is private property, if the "neighbors" do anything like this again I'm calling the cops. ;) And I showed her a copy of the alarm permit I just got and told her about the alarm and cameras that are coming...
