NEW YORK. When the tenant rented a garage, I gave the tenant a receipt for it their rental deposit. It just had the address of the property, the amount of rent, and the duration they could have it for, and my signature. It also said that if I sold the house they would leave, as I wouldn't have the garage anymore to rent them. There are no terms of residency or terms of occupancy. It was for 2 years, so they can't claim an oral lease. The address of the person renting it wasn't on there, and they didn't sign it. I was also supposed to be sent a copy, and when I asked for it again, I was told I already had a copy, which isn't true. They are refusing to send a copy of their receipt. I was promised a copy at the time they signed it.

Of course they could now add other things to it, after I signed it but this was given at the time she took the property, and there was discussion of doing a lease several times after. When I no longer wanted to give them the 2 years as they are a real pain, they then claimed the paper I gave them was their lease. My attorney says it isn't a lease, but he's been wrong before ;-).

Need to know if you think there is any chance they have a lease, as I want to send a 30 day vacate notice. Any good places to find one free on the net? Thank you!

dont know if they have a "lease" or not, check out the "state resources" at the top of this page.
as far as the forms, this page has a "Legal Forms" page you can browse through. it covers just about all L/T situations.
