Is this a purge? Who gets the money?

State is FL. FL holds jurisdiction over custody and child support issues. NCP mom lives in VA.

Hubby got a legal document from the VA courts in September. As we get closer to December and January he is wondering about the following:

Type of Case: Show Cause Failure to pay support
Plea: Guilty

Findings of the Court: As of 8/27/07 child support arrears are $2595.84 and interest of $141.28. Defendant is found guilty of contempt.

It is ordered that: The Respondent shall serve 30 days in the Virginia Beach Correctional Facility. The sentence is suspended conditioned upon the Respondent complying with the following:
1. Paying $1000 lump sum to the Clerk of Court on or before December 1, 2007 (crossed out, January 2, 2008 handwritten in) and
2. Complying with the current support order of $45.00 per week for current support and $10.00 per week toward the arrearage.

Note: the lump sum shall be paid in cash or USPS money order to the clerk of court no later than 4:00 PM on December 1, 2007 (crossed out, January 2, 2008 handwritten in).

It is further ordered that: If the Respondent fails to pay as ordered for more than thirty days, DCSE is authorized to make application to the court for non-compliance capias in accordance with Va. Code 16.1-279.16

Is the lump sum a purge, or is it a fine of some sort? In either case, does the money go toward the CS arrearages or does the state keep it? I've looked at the VA Codes, and they are not as reader friendly as the FL statutes LOL.

Purges REDUCE arrearages. Unless the OP likes to have 3 meals served behind bars, I would find a way to pay the money.
Correction: unless the OP's hubby likes having 3 meals served behind bars, find a way to pay the purge BEFORE the deadline AND pay the current support amount.
 
the MOM is the NCP... mom is the one behind on child support...

OP is asking if her husband (the CP) will get the purge amound

Okay, I give up ... purge money goes to the person the child support is owed. Purges reduce child support arrearage.

I am the current wife of the Custodial Parent...aka the wicked stepmom LOL. Hubby can't call the courts from work, and I'm not a party to the legalese, so I won't call for info. I told him I'd put it up here if he wanted to see if anyone knew if it was a purge or a fine.

When hubby was the NCP, he paid on time every month with no excuses. We had some rough times, but made it through alive.....but....he was military, a decent human being, and a dad. Mom in this situation seems to think she's above the law, but it's all catching up with her.

Enough of my rambling. Thanks everyone.

Just so its absolutely clear. Your husband will receive the 1000.00 lump sum payment.

SD goes into Middle School next year, so that money will definitely come in handy for all of the activities she will likely want to participate in. Or else it'll make a nice chunk of change for her savings account.
