My husband was arrested recently for assault on me.It's supposedly the 3rd or 4th time he was arrested for this although he was only convicted one time.He was ordered to go to anger management of which he never complied.
My question is this: (hope this isn't too confusing)
1.Will the courts look at the fact that he was arrested before,yet not convicted? Will they find out that he didn't comply before for the first offense?
2.Won't it make a difference that he has a criminal attorney?
His attorney actually defended me for a case that was totoally unrelated not too long ago.Doesn't that make this a "conflict of interest?" Seems to me it would be.That doesn't make sense to have an attorney defend him,that just recently defended me,and was supposed to be going back to court with me to finish something up as well,although the police took out the assault charges,not I.
3.By chance would anyone know what he could be facing (any jail time) if convicted this time around?
There was an eyewitness (my mother) but I don't think she will be going to court.This attorney doesn't exactly fight dirty either.He also has a record (5 time felon) but I don't believe that makes much difference (from 25 years ago) and was also arrested for third DUI at the same time.
I know......a real winner! I left him back in April
