If a lawsuit was filed, and then withdrawn, can a Judge "dismiss" a lawsuit that is no longer before the court, and consider it frivolous,imposing a prevailing party fee?
In addition, this Judge "threatened"my present atty not to pursue the case of Elder Abuse and Financial Exploitaiton, or he would impose "sanction" against him. Is that judicially and ethically correct?
I am only interested in the fact, I want to file the suit in another jurisdiction and am unable to do so, if the case was dismissed. Is it not my civil right to demand damages, when I have suffered 5 years of unprecendented litigation regarding my own assets being taken from me under a coerced settlement.
