IS this loan fraud and do I have a duty to report it --

Would you call this loan fraud? Could I get into trouble and what do you advise....
I have a marketing company — and my fiance has a business. He recently took a business loan to get his business off the ground. 150k.

However, the loan requirements include that the owner provide direct receipts for all purchases and there can only be so much money per category.
He comes to me and asks me to write a receipt for a certain amount (15k per year) to do the marketing for said business.

I did so — and got paid. However, he tells me 3 days later it was all a scheme to get the cash and demands it back ASAP to help the business survive.

I say no — it’s for marketing. He accuses me of trying to “steal” the money and demands it back at once or says he will call it theft!

I returned the money, but now I’m scared. Is he going to get in trouble for loan fraud and will he take me down with him? I did not know he was going to sabotage me! The amount hit my bank account and I wrote a check to him for the amount and labeled it "return for contract severed by __)

He also went and bought a bunch of computers and returned them, as well — to take the cash. Sure, he will still have to pay it back — but this is LYING.

I asked him to return the money (marketing money) to the bank and he said I was ridiculous and that he needs the money to stay afloat and that the only way the bank wouldl ever find out is if "I" reported it -- and he said he is very concerned about the way I am talking to him (stating that I feel it's fraud).

How do I deal with a fiance who is committing what I would consider loan fraud and has now involved me… advice? I think I have covered myself enough -- but do I have a duty to report this?

If so -- how? I couldn't sleep last night TERRIFIED that he has implicated me in a crime... we live together. He's nearly broke. The business is not barely making it into the black and he is currently living off his retirement. He has ZERO personal income at this point...

Get out of there - it won't get any better and in fact, will probably get much worse.

Thanks for saying this....I do feel very trapped.

I had a family friend/lawyer tell me that I should email him and state that I have returned the money, however I would like to see it go back to the bank.

I know if I do that -- he will BLOW up and basically say he's done with me because I am clearly "framing him" or creating a "paper trail"....which I am only to protect myself!

Even if I don't turn him in -- that email will send up huge red flags.. and he will probably leave me.

If I quietly report this -- he will probably get in trouble and I will have to deal with that?

And if I do nothing -- I worry for the next how many months?? that we will both go down in flames...

I am very trapped and I do love him...

I suspect the OP is complicit in these matters and is just trying to formulate an escape plan.

Your fiancé? And yet you don't want to leave him .. so you are complicit. Especially if any of this money is spent for your benefit. Why won't you leave him?

But, that can't be true -- I would imagine it would be very easy for them to find out, correct?

I am considering calling the bank myself and letting them know...

I just hope that he doesn't issue you a 1099 at the end of the year for that money, sticking you with paying income and self employment taxes on that money. You absolutely do need to have a paper trail showing that you gave the money back to him. Make sure that you get and keep your cancelled check in a very safe place.

This is also a relationship that you need to get out of.
