Is this malpractice?

I live in North Carolina. My father had a stroke due to a blocked artery. There is a strong possibility that this blockage is due to a high cholesterol level. He recently saw a new doctor who questioned whether or not his other doctor had prescribed any cholesterol meds. He had not. Nor had my father ever been told by his doctor that he had a cholesterol problem. Also, my father was not given a drug called TPA when it was determined that he had a stroke. This drug could have reduced the damage done by the stroke. It must be given within 3 hours of the onset of the stroke. The EMT's were told this,but the med was not given. My father now has no use of his left hand. He has limited use of his left leg. Is this malpractice.
