What is the name of your state (only U.S. law)? Florida. My problem is that my good neighbors have moved out. They don't know yet who will be moving in downstairs. If I sign the lease and get neighbors from hell who party all night and or make a lot of noise all the time can I legally get out of the 1 year lease?

I am sorry to hear that I am out of luck. I guess I will just call the cops every night if I end up with neighbors from hell.

This is one of the dangers inherent in apartment living. A few possible options, (if your LL is willing), would be to ask for a month-to-month lease which would permit you to split without repercussion after 30 days notice. Alternatively, you can ask your landlord to renew your 1-year lease one month after the new neighbors move in, giving you a window of time to see if they are escaped zoo animals before you resign.

Or, being the upstairs neighbor, just remember that gravity is your friend and open a 24 Hour Bowling and Clog Dancing Studio in the room above the new neighbors' bedroom.
