What is the name of your state (only U.S. law)? TX

I applied for a position with Customs and Border Protection and received a call today with an offer. I was given 3 days to call back with a decision because of my situation with custody and having a geographical restriction.

I mentioned to my ex (through email) a while ago that I had completed my background and it was pretty much downhill from there and I wanted to know if she would consent to my moving. She didn't respond. I honestly didn't think that I was going to get good news because it had taken so long for them to get back to me, and began pursuing other things.

Having this job would increase my salary almost 3 times the amount I make now, and I can afford to provide for my children better health care coverage, put money aside for college, and just give my family a better life overall. The downside to this is that I would have to leave this area and the closest I would be is about an 8 hour drive away. From there were talking possibly different states.

The last time my ex saw our daughter was December 28th when she dropped her off to me. Since then she has been emailing me to say she wasn't picking her up and such. finally she emailed me late January and said that she wasn't going to keep emailing me to tell me that she wasn't getting her, she would just let me know when she was picking her up. She missed her birthday, no call..card, nothing.

I felt some of it was my fault because I had taken a much needed aggressive stand on strictly abiding by the order, so after she sent me that email I responded by telling her it concerned me that she wasn't picking her up and if there was anything I could do, even operating outside the order to help facilitate her getting our daughter I would. That was almost 2 weeks ago and she never responded. I told her how much our daughter misses her and wants to see her but she doesn't even bother. I let our daughter call her mom and leave a message to call her back...that was a week ago.

My impression is that she's likely not concerned with having a relationship with her and my attempts at trying to get her to do anything are pointless. I'm very excited about this opportunity to better myself, create stability for my family, and offer my children opportunities that I didn't have. My only problem is getting permission to move from mom or through the court. I think right now, she would deny it based solely on spite. My question after all that though is what would it take to prove to the court that moving IS in the best interest of our daughter?

That's another problem I'm facing. I know that Mom has priority over anyone in these circumstances, but I can't even get her to write me back or communicate with me whatsoever.

I honestly don't know what will happen except that my wife will be the one to care for her throughout that time.

Does anyone have any answers for me?
