I have just been contacted by a debt collection company that is making themselves sound like a legal firm. I am suspicious of them, but I called them and they seemed really nice and straightforward, so I feel a little better.
One of my credit card companies (the one with the highest balance that I can't afford to pay the minimum on) is going to pursue a judgement against me. I have tried to negotiate with them, but at this point, they want $968 down to make a payment arrangement and $200+ per month, which is impossible for me! I called them about a week and a half ago and discussed payment arrangements and when they quoted me that amount, I told them it would be impossible for me to agree to that. It must have been after our talk that they started this process. The company that has contacted me has told me that I've been assigned a case number and it is set to go to court next week. They recommended that if I can't come up with $2500 to agree to the settlement offer, I should consult the State Attorney's Office to find out my rights and whether or not the CC company can garnish my wages. I am really worried at this point, I have never heard of this before, but from reading here, it seems like a pretty serious thing. I am willing to make payment arrangements, but I can't neglect my living expenses! I am especially worried about my new job. I just started here on March 1st and I would hate to have to miss work to go to court and I would really hate for my 1st paycheck to be taken from my bank account, which I have heard can happen. Aside from more research, what's the first thing I should do? Call a lawyer? Stop automatic deposit on my paycheck? Help, please!
