What is the name of your state? South Carolina
I went thru Chapter 7 bankruptcy in 2002. I filed in May, 2002, my meeting of creditors was in June, 2002 and I received my final discharge notice in August, 2002. I have been carefully trying to re-establish my credit and have done a good job over the past two years. Part of that is carefully monitoring my credit report(s) and making sure all the loose ends of my "past" life are tied up. In the process of doing this, I have discovered that one of my creditors (Providian Financial) received a judgement against me in South Carolina Circuit Court for one of my credit card debts of $2,000+. The judgement was handed down in a county that I did not live in (I reside in a neighboring county) and I never received a summons or was served, etc. from this court. This judgement was awarded to Providian by default in March, 2002. I filed for my bankruptcy in May, 2002. Providian (and this credit card debt) was on my list of creditors and Providian was notified by my bankruptcy attorney. Providian even sent a return receipt acknowleging the bankruptcy notice. They did not send a representative to the creditors meeting and they received a copy of my final discharge notice. My credit reports with all 3 bureaus show this Providian debt as being discharged under Chapter 7. None of my credit reports make a mention of this judgement. Is this a clerical issue that I can resolve with a letter asking that the judgement be stricken as this debt was discharged under Chapter 7?
