Jurisdiction Question

What is the name of your state? Pennsylvania and Missouri

My husband is currently paying $370 a week in child support for two children in Missouri. (His ex moved there with the kids after the divorce) His lawyer in Missouri would like to try to have his support moved to Missouri because he thinks it will be quite a bit less. However, I'm afraid that if we do this...he could end up paying support through the kids college years in addition to being saddled with education expenses. It's my understanding that it's not impossible to be forced to continue to pay in PA but less likely.

Now please mind you...he wants to do the right thing by his kids. College is one thing--but to pay supporty after the kids are 18? We are struggling to pay bills in a one bedroom apartment while his ex married a millionaire.

Any advice on whether it would be a good move to try and get the support done in Missouri? :confused:

I highly doubt it, it's called "support shopping" the UIFSA prevents it. Since dad is still a resident of PA, that is where the order will likely stay. However, if dad moves out of PA, PA laws regarding emancipation will stand, meaning the child will emancipate under PA law no matter what.

How is it that you think Missouri will cost less? Both states take both parents income into consideration when figuring support. I doubt he'd get a break, plus he'd have to travel to Missouri, or hire an attorney, every time she wants to take him back to court which could cost a heck of a lot more in the long run.
