What is the name of your state? Missouri and Pennsylvania

My husband's ex wife has been playing the court delay game for years. We are in PA...she is in MO with the kids. My husband filed in PA first for custody in 2003. Once she was in Missouir for six months--she filed there. Tired of the delays of having the case in two states...we pulled the case out of PA the end of 2004. Just recenlty...two weeks before we had a final trial in Missouir...she had the case dismissed.

Now we want to refile in Missouri but my husband's lawyer wants get somethiing from PA that will keep her from refiling for custody in PA just to keep this delay going. First...could she refile in PA? What do we need from PA to stop this if she can? And if we refile...can we still use evidence like the counselors report from court ordered counseling in MO that happened before she pulled the case out. Can this be done without a jurisdiction trial in PA?

His ex has nothing to gain by a custody agreement since she is basically holding his children hostage in Missouri. What can we do to stop these delays?

Is there a court order already in place? Where was it issued? Who moved? Has your DH talked to the attorney about possibly filing an emergency order for full custody?
 
She moved. There is no court order in place for custody. Only for support. When we refile in Missouri...he wants to do a temporary order. He just doesn't want her to file again in PA and delay this AGAIN!
