What is the name of your state (only U.S. law)? nyc

I was just laid off due to cut backs at my job and I just wanted to know am I entitled to get paid for my sick/vacation time that I still have left for the year? Its a small business of 30 employees and it is private.

No state requires the payout of unused sick time unless company policy or legally binding contract specifically make such a provision.

In NY, whether or not vacation time is due at termination depends on company policy. However, NY is a little different than most states in that it is due UNLESS company policy says it will not be paid.

So you will have to look at the company handbook and see what it says. If it says it won't be paid, then it needn't be. If it says it will, or if it says nothing at all, then it must.
