My son was a supervisor at a company and had
asked for a ride home one night from friends.
Another supervisor came to the car outside
the company and asked those in the car if
they were smoking marijuana. My son was
smoking a cigarette at the time and did not
think the man would think he was smoking pot, but this other supervisor reported to management that all in the car were smoking pot on company property. There were no drug tests ordered. My son was called in to the office and questioned and he denied any wrongdoing. The company told him they had investigated the matter, suspended him for 3 days and then fired him by phone. He would like to know if this is legal. Should he retain an attorney and could he get his job back? Can a company do this? They refused to let him see any results of their investigation.

If your son works in a state that has an at-will policy, then it is not likely he can get his job back. At-will means that the employer can terminate the services of an employee at any time, with or without a reason. Also, the employee can quit at any time, with or without a reason. Generally speaking, an employer does not have any obligation to allow current or former employees see the results of internal investigations.
