What is the name of your state (only U.S. law)? CA
I'm living in 4 units condo community. Second time in last 5 years HOA due erased (this time by $101 - from $280 to $381. Reason-increased price of earthquake insurance ). In 2005 HOA due erased from $170 to $280. By CC&R HOA due cannot by increased more than 20% over the prior year. $381 makes 224% due increase in less than 5 years. HOA manager responded to my question that 3 other owners made majority decision.
Do I have legal ground to stop raising a due.
Also need to mention that
1. In 13 years I live here we had only 2 board meetings.
2, We newer had yearly budget proposed, we newer had it approved.
3. When I asked manager about some spending (I got access to HOA bank statements) he said he doesn't have and doesn't keep most of receipts.
We never did election of the board and manager.
Should we do that or for 4 units it not a requirement.
