Killing My Neighbor's Tree

Approximately 1/3 of our neighbor's LARGE oak tree overhangs our property. The neighbors will not allow me to remove the tree entirely, so I am left with trimming it at the property line only. The tree trimmer tells me that trimming this much of the tree will likely kill the tree. If the tree dies, and we have not trimmed it past the property line, can I be held liable? How about the tree trimmer?

You can be held liable if your actions on your neighbor's tree kills it. You can end up paying to replace the ENTIRE tree. And if the tree trimmer was hired by you and was working as your agent, YOU are still responsible.
