When we first moved into our brand new townhouse in Chicago, the community was still a construction site. The so-called "Condo Association" at the time was made of developers and there were no services provided at all, namely trash removal, snow removal, no maintenance workers were hired, and many more other services that were listed in the budget. We demanded services and protested the assessment every month for 4 months then paid the full balance at our attorney's advice. However, the so-called "Condo Association" imposed us with $50 late fee that has been carrying over on our account.
My questions are: (1) Was the so-called "Condo Association", that was NOT even made of by actual homeowners, allowed by law to charge us for services that were NOT provided? Since we've paid the balance after 4 months, are we able to get the money back from court if we sue them (the developers, not our current Condo Association made up by homeowners)?
(2) What should we do about the $50 late fee?
