My landlord is charging 10% late fees. That comes out to $55 for me. I heard that landlords can't charge over $25 for late fees. Does anybody know what the law is for this in California?

How did he come up with 10%?

Was it written in a lease? Then you signed it so he can charge it.

Are you month to month with nothing in writing? weeeellll with NOTHING in writing how can he prove its 10%?

He cant so you dont owe it.

but then he will give you a 30 day notice to move, then what?

It's month to month. 10% is in the "Standar month to month rental agreement". This agreement says the minimum temamcy is 18 months. I've been there a few years. I'm assuming this agreement would still be in affect. Or was the landlord supposed to write up a new one after 18 months? The landlord raised the rent on me a few months back. Was she supposed to write a new agreement for that? She didn't. Can I hold her to the agreement that we already have?

a month to month is just that.........

you have a place at a certain rent for 30 days.

The landlord can change the terms every 30 days, by giving you a 30 day notice then its up to you wether to pay it or move.

At least with a lease the landlord can only change the terms when it expires.
