What is the name of your state (only U.S. law)? Ohio My husband has a judgement against him for $11,000 for some remodling work he did. The lawsuit was a sham but thats beside the point.
He hasnt worked in over a year and has been trying to find other employment with no prospects yet. So I(his wife) have been the only wage earner all this time.We are also going to a foreclosure mediation to try to save our home as we are behind in our payments. My question is can the plaintiffs in this lawsuit garnish my paycheck or take any property that is in my name only? I didnt hurry and change anything over to my name as that is what they are thinking. I have a 2000 Mustang that I have had since 2000 and it has always been in my name.I only drive it on special occasions and keep it in my garage otherwise. They think that it is my husbands car so we believe that they may try to take it. I have proof of title showing that the car has only been in my name for the past 10 years. He had no insurance on the business he had so they are having a debtors exam. Any answers would be appreciated.:::![]()
They actually didnt prove their case to the fullest but used pictures that had the dates changed and they had other friends do remodling work over my husbands work before taking pictures of the supposed" bad work".They actually wanted 18,000$ but the judge felt that my husband wasnt deceptive, but took on more than he could handle. We couldnt afford an appeal so we had no choice but to let things go. My husband also had to represent himself in court due to our lack of funds. The judge said he did very well but that didnt help him any. No joint bank accounts. The only thing in his name has been our house(which is going to a foreclosure hearing next month). What about my car? Thanks again.![]()
