What is the name of your state? Alabama
My lawyer hyped me up to belive that since my ex has paid very little of his CS arrears that he would be held in contempt and put in jail. A hearing was set for Friday (02-23-07). My lawyer didnt tell me about the hearing until Wednesday (02-21-07). I am in Ohio (and NCP is in Michigain). He told me I didnt have to come down for the hearing because he felt the NCP wouldnt show up. My lawyer said that if he crossed Alabama state lines the state would have the power to jail him.
Well Thursday evening before the hearing (02-22-07) my attorney sends me several emails and makes several calls to basiclly tell me that he has told my ex ( who at the time had traveld down to Tennesse) that he didnt have to show up for the hearing as long as he signed a paper saying he would pay something towards his arrears. I told my attorney I disagreed with that, at wich point he mysteriously stopped taking my calls or responding to my emails ( yet kept emailing me).
My attorney at one point sounds like he is defending my ex! (Of whom was dropped by his last attorney and is now representing himself) My attorney began telling me all the lies that my ex told him as if they were factual. I pressed my attorney to ignore my ex, and press on with the contempt charge as planned. He ignored me and sent me an email between he and my ex saying they had come to an agreement on all of this. Can my attorney willfuly ignore my requests? This agreement states that my attorney is acting on my behalf, but I told him that what is agreed upon is not acceptable. He said he spoke with the judge and she has agreed to everything. Should I at this point get new counsel? (theres more to the story, but I'm trying to keep it brief) Sorry its so long.
