lease breakage & deposit

My landlord and I (having a good landlord/tenant relationship) decided that it was in his best interest for me to give notice and move out 2 months prior to the expiration of the lease, as I had developed problems with my income. My move out date was 6/12, and the place was re-rented by 7/1. We stayed in touch while I was placing ads to get the place re-rented. Now he does not return my calls. Am I entitled to the refund of any deposit remaining? If so, how much is deducted, if any, for the incomplete lease period? And, when should I expect any amount still due and/or itemized receipt? Thank you.

Landlord needs to send you written notice of deductions within 21 days wait until 22nd day if no response proceed to file a small claim.

thanks south ... i actually knew that much. what i don't know is ... 21 days from when i moved out or from when it was re-rented; and am i liable for the 18 days it was vacant as a deduction from my deposit? i appreciate it. :)

It should be 21 days from the time you turned in the keys. He may have claims to some of the deposit.

right, that's what i'm thinking. that's why i asked. anybody know for sure? i'd like the write the demand letter today (as it has been 30 days since I turned in the keys), but i am unsure of the proper demands to make with regard to the amount of deposit I can expect back.

Yes your liable for the the time the unit is vacant if that falls within your lease period.

Thanks South and Enasni ... that's what i was looking for. Couldn't find that particular scenario in CCC Sec. 1950 ... I appreciate your help. :D
