I have quite a distressing problem that I am hoping someone can answer my question. The circumstances are as follows: I entered into a lease on my home with a purchase option to buy for a certain fixed price within a five year period. FYI: this lease/lease option is with a family member. After approximately three months into my lease (with the rent paid in full), I recieve an eviction notice out of the blue. Then, within a few weeks, I am told I must vacate the house because there is a contract on it. The new buyers do not want tenants, they want to just move in the house for personal use. Imagine my shock and surprise. I immediately put a lien on the property for breach of contract, labor performed, etc. (since I had also built up quite a balance in sweat equity for work on the house).

My lien was put on the property before the buyers signed their contract. The seller, the realtor, and the buyers all knew about the lien and the lease option agreement (it is in writing). I refuse to move until my lien issue is addressed. The sellers have retained an attorney to try to intimidate me and force me to move. My question is: Can I negotiate directly with the new buyers? My reasoning is this: the seller agreed to sell the property knowing about the lien, the buyers bought the property knowing about the lien. Therefore, someone has to take responsibility for paying my lien amount. So, who do I negotiate with? As far as I'm concerned, I don't need to talk with the opposing attorney. This has nothing to do with him, I believe. It is the new buyers who can agree to pay my lien amount, is it not? What other options are available to me to settle the issue of my liens and not have my rights violated anymore, nor bullied anymore. My lease/lease purchase option was blatantly broken. What are my rights? And, what options to I have to pursue them? Thank you very much for your consideration of my plight, and the value of your expertise.
