How do I legally go about relocating to another state? I am legally divorceed with a 13 year old girl. In our divorcee degree it states that I may not reside out of ny state. Her father is in prison for crimes against her for 4-8 years. We both have orders of protection stating he is to have no contact for a 10 year period of any nature. It has been almost 3 years at this point. Can I just leave or do I have to do anything to legally move?

My response:

You have to go back to court to have your court orders changed by the judge. You can't, legally, just pack up and leave. The court is retaining jurisdiction of your child, and that's the reason why your orders say you can't move. You need permission and new orders from the court.

If you leave without going to court first, you will be in contempt of court, your child will be taken from you, and you could wind up sharing a cell next to your ex-husband.

DO NOT disobey your current court orders.
