Legal Guardianship Papers for school?

What is the name of your state? IL

My husband and I have increasingly changing schedules and do not live in the state we work. Because of these reasons, we attempted to try and enroll our 10 yr old daughter in a public school nearby which is also where his parents live. I typed a letter to the school stating that she would be staying with them throughout the week and would be attending school there. In return, they sent us papers to sign Legal Guardianship of our daughter over to his parents. What consequence does this have on our parental rights – would they have the same rights as us or maybe more? Could they use it against us in anyway at some point in the future? Obviously, we are extremely hesitant to do this and are trying to find some kind of after school care should we not be able to send her there. We live in a small town, therefore, very few resources are available close to home. Thanks for any advice.

Legal guardianship does carry with it the rights to make important legal decisions regarding the child and yes it could be used against you down the road. You should come up with some other plan or spend the money for a lawyer in your area to explain to you and your husband exactly what the significant legal ramifications are to giving someone else legal rights over your child. I will tell you this: "I didn't know" will provide you no relief down the road should you go this route.

Thanks for the information. I do have access to lawyers but we've decided to find some other way - even if that means me quitting my job because never will I voluntarily give up custody of my child. We suspect that it is partially a ploy on my inlaws part to find a way into getting custody of her - I guess they think we'll just sign anything. Anyways, thanks again for your response.
