I need to know if I need a lawyer to pursue legal guardianship of my niece. Her mother is homeless, in and out of jail, leaves my niece with friends whom don't give a crap. My brother, well put it this way "doesn't care who raises her". Do I need an attorney, or can I get legal guardianship by myself? Is there a "do it yourself" way? Thanks in advance.

Simple answer.

Get an attorney. Guardianship proceedings are extremely difficult to pursue. Remember, by trying to obtain guardianship, you are, in effect, trying to abridge another's Constitutional rights.

Thank-you IAAL, My brother and his ex girlfriend are willing to let me be legal guardian. I guess I will contact an attorney.
