What is the name of your state (only U.S. law)? WA
so now that marijuana is legal in wa, can my landlord still kick me out for smoking it?
i know i can get fired for using it, but i'm not sure what my landlord can do to me. thanks!

Sure they can. Just because it is legal in the state doesn't necessarily trump the fact that it's still against Federal law.

I suggest you move to a 420-friendly building instead of putting yourself at risk for eviction.

As stated before, yes, you can be evicted.

Since marijuana is still considered an illegal drug by the feds, your LL has every right to evict you. Most leases have a clause specifically stating any illegal activity is grounds for immediate eviction. Simply owning and possessing it would fall into thia category.

As a landlord in the state of Washington, I let my tenants know prior to the election and again afterwords that the use of marijuana in my homes is still prohibited. The first letter also included an addendum to the lease just in case giving the proper 30 day notice of a lease revision.

i assume these answers are the same for medical marijuana? i'm still trying to find an edible i can stand, then noone will ever know since there will be no smell.

Yes. The answers are the same whether we are discussing medical or recreational marijuana use. Neither is recognized as legal according to federal law. That would also apply to edible marijuana.vs. that which is smoked. Pretty much ANY illegal drug use according to Federal law trumps local statutes. Illegal in Federal law is illegal drug use in the eyes of your LL.

hmmm. interesting. it sounds like they have more of a problem with people who smoke, rather than using it in other methods. thanks for the info.
