My son is 16 and for the past 13 years I have been married to his step-father. We live in Nebraska and my son wishes to legally change his name to my husbands last name. My son was born in Texas and his real father is not listed on his birth certificate since we were not married. There is no chance that my son's real father will ever contact him and my son has my maiden name as his legal last name. What are the procedures for getting his name changed and do we have to do it in Texas or Nebraska. He is considered a legal resident of the state of Nebraska and uses his step-father's last name unofficially.

You will need to petition the courts for the name change. Contact an attorney to have them give you detailed information as to what you will need to do about the father. If the father isn't on the certificate, does he pay support? I'm assuming not, if he has no contact with him.

Do you plan on having your husband adopt your son? Or just change his name?
