My response:

A subpoena duces tecum is an "order" to compel documents and other physical things (either prior to, or at the time of trial) issued on behalf of a party, with the full weight of a court order. As a matter of fact, it is a court order. An attorney for a party, or any party not represented, may cause such subpoena to be issued and served without further orders of the court.
