I don't pretend to know the terminology when considering legal issues, but there may be a guideline in your state about when a person's assets can be 'given' to children and not count against them (the parent). In my state the parent would have had to place everything in their children's names years ago (like 3-5) for the nursing home not to be able to count it as an asset. Maybe a good place for you to start would be to look at your state's guidelines.
