I purchased a new Suzuki LX7 in Sept of 07. Shortly thereafter, the engine light came on. It was reset and came on again. The repair necessitated the removel of the engine to replace a cam shaft. The repair took 2 wks. The car had to be back in for repairs caused by the dealership ( scratch and broken piece). In Decemeber we noticed that when the fan for the heater was on full blast it only blew heated air when the car was moving. When stopped, the air was cold. We returned it again. It has been returned to us twice since then, both times we didn't even make it home before we realized it was definitely NOT fixed. They have had the car for more than 30 days at this time.

I have called Suzuki who referred me back to the dealership. After the 3rd time we returned it for the same issue, I emailed and wrote Suzuki stating we wanted to return it under the Lemon Law. Today I received and email from them denying that and referred me back to the dealership. Today the dealership called, suggested we call the Better Business Bureau and that since they THINK they have the problem fixed we need to pick the car up.

I am very uncomfortable even taking the car back because I feel that as long as it is in their possession, I have some leverage but I also realize that if the car is in fact fixed we are stuck.

My question is, under Indiana law, have we met the criteria to return the car under the Lemon Law.

You paid a lot of money for this car.

You have been denied.

You should contact a lawyer.

Not picking up the car won't make it a lemon or not, but will potentially subject you to storage charges (which may be astronomical)
