An individual who holds the mortgage of a condo I own has suffered a stroke. I want to sell this property soon. I am up to date with payments but my lender is pending legal conservatorship and cannot participate.

Do I have to wait until his legal issues are settled?

No, you don't have to wait but...

The problem; you may have difficulty obtaining an accurate and up to date payoff. Somebody will also have to sign the release of the security interest as well.
