Dear Sir:

I have a question about my husband. He came here on a J1 Visa a year ago and worked for 8 months. Unfortunately, he was fired for no fault of his own and lost his Visa. His former employer refuses to be the least bit considerate or helpful in the situation he has placed my husband in. Although we have filed for a waiver of residency requirements (he is from India), he has not been allowed to work for the past six months. Initially, the INS said processing his application would take 45 to 60 days but it has taken over six months and regardless of our attempts to communicate with them, we still hear nothing. We have written and called many times but we never get a response and the one number that we can call to get information is busy all day making it impossible to get through. We both feel as if we are writing into the abyss and no one can hear us. How long will this go on? My husband has a PhD and was offered a job by NASA recently. When they contacted his former employer he gave a very bad reference and the job offer was taken back. Even though my husband has several good letters, this one is all they need against him to not give him the job. They were going to file for an H1 Visa and get him a work permit but that is all off now. So, I guess my question is how long is long enough to wait on the INS? Should we fly to Nebraska or can we take care of the waiver application from a state office? Also, what right does my husband's former employer have to ruin future job opportunities? I am an American citizen since I was born here, but feel totally at a loss when it comes to helping him. Also I am a journalist and do not get paid much, we barely have enough to live on, God forbid if there was any disaster. What advice do you have for us? We were married Jan 13, 2000. Though we haven't been married long, I married him for all the right reasons since I love him madly. I can say for certain he would not even stay in the U.S. if it wasn't for me. Please help!
