My husband and I were first time home buyers last year. We found the perfect home and moved quickly to buy it as it had a lot of interest. The seller offered up a disclosure form stating that the house was in good working order.So we bought the house moved in and everything was great for about eight months then one day we wake up to a lower level filled with what we thought was smoke. We chalked it up to the lint trap being full. But it kept happening and we finally noticed it was coming from the boiler room. We contacted our oil company who is the same oil the previous owner had. When we explained the issue they were not surprised because they had paper work documenting that the previous owner had called on a similar problem and they made her aware that it needed to be replaced as of the date of last service. Is the previous owner responsible at all for this seeing as she lied on paper and lied to us on a walk through of the house when we asked specifcally about the heating system.

Did you have the house inspected prior to your purchase? Is so, was does the report say.

And, yes, based on what you've told us, the seller is in deep do-do for lying on the disclosure form. Get the paper work (proof) from the oil company. Get estimates on repairs and replacements. Then contact the seller to negotiate.

We did not have a home inspection. My father in-law who is a licensed contractor came and did a walk through of the house and asked all the questions. He also asked specifically whether the heating was in good working order and she said yes.
