I have a question, or clarification of an answer already given...

I am inCt, the children and divorce were in Ma. There is no enforcement of life insurance stipulated in the divorce papers.

I recently bought policies for myself and my husband, mine would be to help care for our child, my husband is beneficiary. My husbands, I am benificiary, and I would make some sort of fund for all of the children, our 1, and his 3 from his first marriage.

my husband is always up to date and on time with his support, if anything happened to him or me for that matter, we really have no estate to leave behind, to sue for child support on.

so I guess my question is could the ex sue for future support from a dead man or not, and take this entire life insurance away from me and my child, in this case?

I really hate asking this question, as it is so morbid, and probably the last thing me or her would think of but I am curious.

I know in our case we have TWO policies for my husband. One for her and her kids and one that names me and my son. They are totally separate so that she has NO claim to mine and visa versa. You guys should consider this just to protect everyone involved. It sure takes the guess work out of the equation. Good luck!

yes, I did think of that, but it still seems silly, my having to pay for two, if she wants more money for herself, I would think she could pay for her own policy on him! that seems fair to me. oh well, I am getting more philosophical than legal about this....

As silly or morbid depending on how you look at it...it is SOOO worth it to me to know that my A** is covered and BBFH can't touch MY sons money if you know what I mean. This woman thinks everything my husband makes or owns should go to her and HER kids...so this solves my problem. Her CS, SS and money for the youngest for college are MORE than covered by this policy, plus she would get SS benefits for youngest as well, and $37.00 per month is a cheap way to have peace of mind :D. Once we are done paying support (6 yrs), THEN we will change policy to me as benificiary and I will be taking care of all the kids in the event of his death. Think about it no matter how silly it seems :} JMHO

When I posted this question this is what I was told.

should my husband die before his son was 18, and if there was no life insurance policy to cover child support for the up coming years of the sons life, then yes, his ex could come and take what was mine and my childrens.

However, the home is in my name and was before we got married, and the blazer was a gift to me from my father and is in my name. the land is being leased at this time. so basically she can't touch anything of mine. But she can try.

thanks guys, I called ins. company, another 11.00 I can get another policy, same as the other, wont really miss it. I dont think anyone would think of it, and lord knows, the money wont get spent on her kids, but I will be able to sleep better, and he will know we tried to do the right thing! still burns me though! but at least as you said, less worry at a really bad time, if this were to happen, and thats what the ins. is for.

I talked to my mom about this, she has been divorced from my dad 20 years, she still pays a policy on him, she is beneficiary of, he never paid anything, she figures this is the only way she will get anything! LOL

Good Choice! That 11 dollars a month is security for YOU and your kids and just think you'd spend more at McDonalds!!! Well worth it!

:D I love the mcDonalds comment! thats how I justified it in my mind actually,and lord knows you can still scrape up the "McDonalds" money somewhere.now if I could just get my dH to see that logic with a retirement fund LOL!

oh well, one step at a time!
