My ex is required to provide a life insurance policy that my daughter is beneficiary and I am the owner. He did. the policy was due to mature 4/01/01 and insurance co. called to offer new policies. Agent called ex and ex applied for (1) new policy per our child support agreement and (1) additional policy requested by me and I would be financially responsible for. Here's the fraud part: he applied for both policies as a non-smoker. He is a smoker and I informed insurance company and I insisted that the policy that I would be responsible for be a smoking policy. EX then cancelled his 1st application and applied yet again for a new policy to replace the old one but his estate is the beneficiary and he is the owner. Months passed and the policies were delivered. He signed his new policy and then my policy that I would be responsible for. Mine was delivered to me as a NON SMOKER policy. COMPLETELY against my requests for SMOKER. I hired a Private Investigator and he taped him SMOKING. What are my options now?

Basically, you have little you can do. You have already told the insurance company that he smokes, let them handle it. As to your policy, cancel it, so that you are also not caught in his story.
