My fience is in jail for violating his parole on the law of the lesser of two evils. He has been before the ALJ and is still awaiting to go before the board. He has already spent 90 days in jail. It has been 60 days since he went before the ALJ. What I want to know is dose he qualify for the statuet KRS 533.040 subsec 3? If he dose what dose he do to get this in motion.
