A couple of weeks ago I recorded a two year lease purchase agreement and performance mortgage from the owner of a residential property. A deed was also notarized and placed into escrow at a large title company. Option consideration paid. Now that my sub-tenant has moved in, the owner has changed his mind, retrieved his title (we have our copy) and is actively contracting with a property management company and personally visiting my tenant, saying that they are not to pay me anymore rent and that my tenants are to deal with him from now on. A lis pendens has been filed. Can we foreclose on our interest in the property? (There is a primary lender).
