Greetings,
Have a neighbor who was recently served with a warrant to his search home, during the search a listening device was planted by one of the officers. It was found the next day by the wife.

The listening device was handed over to the families attorney, when questioned a few days later about the listening device the attorney blew the question off. Given the recent history of the local government as well as the officers involved who served the warrant, it's very likely the device was placed illegally.

I have been given my neighbors permission to request information from her attorney regarding her case. How should I go about requesting information from the attorney and the police department regarding the device? What specifically should I ask for and from who? Any agencies out who would assist in resolving this? A statement from her attorney stating he received the listening device comes to mind, however, as he has previously avoided the question by his client, this may prove difficult.

If they had a warrent to search the home, it's very likely they had a warrent to plant the surveilance device as well.

And the neighbor KNOWS it was a listening device and was planted by the police ... how?

Given the recent history of the local government as well as the officers involved who served the warrant, it's very likely the device was placed illegally.
That's a little scant, but, okay.

I guess you call them up and ask. Of course, they do not have to give you squat.

If you want the information have your neighbor get it from his attorney and then he can hand it over to you. The police may not give you the time of day, nor do they have to.

Who issues warrants and who typically keeps records of issued warrants? Would permission to place a listening device be covered in a separate document? If so, who would issue this document?

Search warrants are issued by the court. Sometimes they would be sealed.

Understand that local law enforcement agencies utilizing listening devices are extremely rare. So rare as to be nearly unheard of. Unless your neighbor is thought to be a John Gotti wannabe, it may not be what he is telling you.

You realize that unless you are an attorney representing your neighbor, no one has to give you anything concerning this case.
