I sent my landlord a certified letter 40 days before moving. He doesn't pick up the notice and claims was not notified. The information the post office supplies only has the date with the city and zip on the receipt, did not get the letter back. landlord claims this does not prove the letter was sent to me. What is the precedent in Florida cases like this?

Let's get something straight .

1) I sent my landlord a certified letter 40 days before moving. He doesn't pick up the notice and claims was not notified.

OK

Post office usually returns a certified letter to the sender after so many days it's not picked up? If so, you do not open it and take it to court.

2) The information the post office supplies only has the date with the city and zip on the receipt, did not get the letter back.

Who's City and Zip on the receipt ?

3) landlord claims this does not prove the letter was sent to me.
What letter ?

I agree , if you sent LL letter and it was not delivered and returned to you by post office leave it sealed and let the LL explain to the court why the mail was not picked up. If you have not gotten the letter returned to you then go to the post office and ask them to trace the history of it from your reciept number and let them get back to you , if LL did indeed sign for it they will have a record of it.

For further reference send the Certified mail with receipt requested .

Perhaps that's why the LL is stating you have no proof .

As Farmer stated have to PO trace it's activity.

Agree with all of the above. I always suggest to have the letter sent certified with receipt requested. Never just send certified. That goes for everything.

I did not put my return address on the letter. On the web while the post office was delivering notices it would show his name and address. After it was returned, Or thrown out, it only shows the city and zip that it was delivered to on the web. Went to the post office said they keep records for 6 months. the receipt states 2 years and its more than 6 months but less than 2 years. How do you get the name and street info?
