LL Refuses Rent.

To recap: continual problems from the moment we signed the lease, quite literally. We live in FL and I have read Title 6, Chapter 83, though I'm not sure what might pertain to my problems.

The most recent problem with our apartment management began (or was revisited, depending on perspective) June 2, 05. We have yet to receive a bill for the water, though we have twice received overdue notices. The time before last, my husband called the water company to pay over the phone. The billing agent told us that the apartment takes care of the bill and we owed nothing. The last time we received an overdue notice, he was referred to the apartment management. They told my husband that they take care of it and it was already settled, we owed nothing. Lease is just all sorts of contradictory; lease main page says tenant is responsible for all utilities, a seperate piece of paper with the lease, signed by all parties, titled "Utility Addendum" states that management ias responsible for water and sewer.

Thursday last I found on my door a note from management stating that our water bill was overdue and no rent would be accepted from us until such time as it was brought current. Since we had already paid June's rent three weeks ago, they attached to the note a money order made out to no one, in the amount of our rent. The check was in an envelope and left on our front door (nice, secure place). They informed us that the June rent was now unpaid and we would be assessed 10% late penalties.

I sent a letter CMRRR and phone the management to file a complaint. The gal I spoke with claimed she knew nothing about anything and that she would leave messages to return my phone call for those who knew something about their job. My phone call has not been returned, and the green cards haven't come back yet so I am not sure if the letter was received.

What DID arrive is another note taped to my door. Received it today but the note has a little addendum at the bottom stating that the rental employee delivering attests that it was delivered on such-and-such day (which the note says was yesterday).

The note we received today said to pay rent plus late fees by the 9th or move out immediately. However, they won't accept the rent. On the one hand, I think it would be almost funny to explain all this to a judge (Yes, your Honor, we actually paid three weeks early. They didn't want it, won't take it and now want to evict us... because they won't take our check.) On the other hand, I've had quite enough of the run-around. I have an attorney but their first appointment isn't until next week. Any ideas would be nice. I have been a pro se litigant twice now and can file lawsuit if that is what is necessary, though I haven't a clue what I might sue under or what my cause of action or damages might be. (My prior lawsuits were FACTA matters.)
