What is the name of your state (only U.S. law)? Virginia

I've been in a long distance relationship with my SO for 4 years now, we're thinking about marriage but I still want to finish school in my home state. My SO overstayed his visa (over 10 years). I was wondering if we can still marry and be long distance for the next 1.5 - 2 years, and what complications would arise since we are long distance and he overstayed.

Long distance relationships rarely work out even under the best of circumstances.

Add to it that your SO is in the country illegally and is subject to deportation at any moment.

I hope that the OP comes back and clarifies, because I took what she said to mean that her SO was outside of the country and had a 10 year ban for overstaying his visa.

That would make the idea of a long distance relationship even more foolish.

Of course, that's not legal advice and she's free to do whatever she likes.

To clarify, my SO is inside the US. He over stayed for over 10 years, if he leaves the country he will have a 10 year bar from reentry. Again, since we are long distance, what complications do we have LEGALLY if we are married but still long distance? I don't understand what you mean...there are no legal bars to having a "long-distance" marriage. Are you are asking if you "long-distance" marriage will be able to be used to help your SO legalize his presence in the US?

The reason he can't come live with me is because he has his own responsibilities. He has a job and home in his state. We cannot wait a couple of years and take a chance with the new President-elect.


I don't understand what you mean...there are no legal bars to having a "long-distance" marriage. Are you are asking if you "long-distance" marriage will be able to be used to help your SO legalize his presence in the US?
The legal bar is from reentry into the country if he were to leave now, not the relationship. Yes, I'm asking what complications we will have for him to legalize his presence in the US, if we are married while still maintaining the distance in the short term.


The big question is that will they question if it bona fide marriage because we are long distance? And as referenced in my first post, we have been together for 4 years, additionally we have known each other for nearly 10 years now.

Sorry, but you will have a hard time convincing them that its a bona fide marriage if you are not living together in the same household.

That's what we're afraid of... Is it impossible or just difficult? Do you know of instances like this that have resulted in adjustment of status for the overstayer?
