I have been divorced for 5 years. During the process, my ex and I signed a Seperation Agreement which stated in part that I would pay her $3000 per year for as long as I received a Variable Seperation Incentive from the Air Force or until I died. We were subsequently divorced. This payment was not mentioned in the divorce decree. She has now remarried and I stopped sending her the check. She is now threatening to sue me for breach of contract. I use the logic that the Seperation Agreement was an agreement which was superseded by the divorce decree. Any thoughts??? One more thing, I have been writing it off my taxes as alimony and she has been paying taxes on it as the same.
